Please read these Terms of Service (“Terms”) carefully before using Bestsellers (“we”, “our”, “the Shop”). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Scope of Services

Bestsellers is an online bookstore operating in Germany and serving customers across the European Union. We offer physical and digital books for purchase through our website. We reserve the right to modify, suspend, or discontinue any part of the service at any time.

2. Account Registration

To place orders, you may create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate and complete information and notify us immediately of any unauthorised use of your account.

3. Ordering & Contract Formation

By placing an order, you make a binding offer to purchase. A contract is formed when we send you an order confirmation by email. We reserve the right to decline orders (e.g., due to stock unavailability or pricing errors) and will inform you promptly if so. Prices are shown in Euros and include applicable VAT.

4. Prices & Payment

All prices are listed in EUR and are inclusive of German VAT (Mehrwertsteuer) where applicable. Payments are processed securely via Stripe. We do not store your full payment card details. You agree to pay all amounts due at the time of purchase.

5. Delivery

Delivery times are estimates and not guaranteed. Risk of loss passes to you upon handover to the carrier. If a delivery fails due to incorrect address details provided by you, re-delivery costs may apply. We deliver within Germany and select EU countries.

6. Right of Withdrawal (Widerrufsrecht)

As a consumer in the EU, you have the right to withdraw from a purchase within 14 days of receiving your order, without giving any reason, in accordance with § 312g BGB and the EU Consumer Rights Directive. To exercise this right, notify us using our contact form or by post. Return shipping costs are borne by the buyer unless otherwise agreed. The right of withdrawal does not apply to digital content where download has already begun with your consent.

7. Statutory Warranty (Gewährleistung)

You are entitled to statutory warranty rights under German law. Defective goods may be repaired, replaced, or refunded, according to §§ 434 ff. BGB. The warranty period is 2 years from delivery. This does not affect any additional voluntary guarantees we may offer.

8. Intellectual Property

All content on this website — including text, images, logos, and software — is protected by copyright and other intellectual property rights. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

We are liable without limitation for damages arising from intentional misconduct or gross negligence, and for damages resulting from injury to life, body, or health. For ordinary negligence, our liability is limited to foreseeable, contract-typical damages. Liability for indirect or consequential damages is excluded to the extent permitted by law.

10. User Conduct

You agree not to misuse our services — including attempting unauthorised access, submitting false information, engaging in fraudulent transactions, or violating applicable law. We reserve the right to suspend or terminate accounts that breach these Terms.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, mandatory consumer protection laws of your country of residence also apply. The place of jurisdiction, to the extent legally permissible, is Germany.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board but are willing to seek an amicable solution.

13. Changes to These Terms

We may update these Terms from time to time. The version published on this page at the time of your order or use applies. Continued use after notification of changes constitutes acceptance.
